We, Lung Fung Estate Agency, are committed to fully complying with the recognized standards for the protection of personal data privacy as required under the Personal Data (Privacy) Ordinance. To this end, we ensure that our employees adhere to the strictest levels of data security and confidentiality.

The personal data you provide may include your name, telephone number, address, identification number, and any personal details contained in estate agency agreements, provisional sale and purchase agreements, or tenancy agreements. The personal data collected from you may be used for the following purposes:

(i) To carry out estate agency and related work in connection with the property (or properties) you have appointed or will appoint us to handle for sale/purchase/lease/mortgage application purposes (as applicable); and

(ii) To promote our estate agency services in the future and send you marketing materials about properties available for sale or lease. When we receive your request to stop using your personal data for promotional purposes, we will immediately cease using your data for that purpose.

(iii) To transfer relevant information to the Company’s subsidiaries, affiliates, associated or joint venture companies, banks, the Hong Kong Mortgage Corporation, or financial institutions for mortgage or loan purposes; to the Hong Kong Housing Authority, the Housing Department, the Hong Kong Housing Society; or to solicitors or credit management companies employed by us for recovering overdue commissions or other fees; and to any other persons as required by law, regulation, or order of authorities in the Hong Kong Special Administrative Region or other jurisdictions.

(iv) To communicate relevant information to you through different means, including SMS/MMS, telephone calls, automated voice systems, emails, or printed promotional materials.

Other than as stated above, we will not use your personal data for any other purpose without your explicit consent, unless such use is required by law.

The personal data you provide will be retained in accordance with the Estate Agents Ordinance (Cap. 511) and its subsidiary legislation, the guidelines issued by the Estate Agents Authority from time to time, or the applicable laws and regulations governing such data or documents containing such data.

In accordance with the Estate Agents Authority’s practice circular on anti-money laundering measures, we will retain estate agency agreements, property viewing forms, or similar agreements for five years from the date of signing the provisional sale and purchase agreement.

Under the Estate Agents Practice (General Duties and Hong Kong Residential Properties) Regulation, we will retain (i) records of all residential property listings and copies of all estate agency agreements related to residential properties for three years from receipt or signing (whichever is applicable); and (ii) copies of receipts issued to clients for any payments received and copies of deposit slips for funds deposited into trust accounts with authorized institutions under the Banking Ordinance (Cap. 155), for three years from the date of issuing such receipts.

The personal data you provide will only be accessed by employees who require it for the purposes described in section 2 above and who have received appropriate training in handling such information and maintaining confidentiality.
